Revised sentencing guidelines in trafficking of cocaine, heroin and ice(methamphetamine)

In HKSAR v Hung Ruifang [2025] HKCA 234, the Court of Appeal updated the sentencing guidelines for trafficking cocaine, heroin, and ice (methamphetamine).

 

The Court of Appeal reduced the sentence in cases involving large quantity of drugs, giving the trial judge discretion to pass appropriate sentence.  

 

The sentencing guidelines for trafficking heroin and cocaine after trial are as follows:

≤10g: 2-5 years’ imprisonment;

10-50g: 5-8 years

50-200g: 8-12 years

200-500g: 12-16 years

500-1,500g: 16-20 years

1,500-5,000g: 20-24 years

5,000-15,000g: 24-27 years

15,000-30,000g: 27-30 years

 

The sentencing guidelines for trafficking ice(methamphetamine) after trial are as follows:

≤10g: 3-7 years’ imprisonment;
10-70g: 7-11 years
70-300g: 11-15 years
300-600g: 15-18 years
600-1,500g: 18-20 years
1,500-5,000g: 20-24 years
5,000-15,000g: 24-27 years
15,000-30,000g: 27-30 years
